Why Confidentiality Matters Here
OpsX Mentor is built on a simple premise: real commercial progress requires real numbers, real conversations, and real honesty. None of that is possible without a trusted confidentiality framework. Every member of OpsX Mentor, and every Fractional COO client, operates under mutual non-disclosure obligations.
This isn't a formality. It's foundational to the program's value. The reason founders can share their actual P&L, their real operational failures, and their honest commercial position is because every other person in the room is bound by the same obligation — including us.
1. Scope of Confidential Information
For the purposes of this policy, "Confidential Information" includes:
- Financial data, including P&L statements, revenue figures, margin data, and working capital positions shared by any member or client
- Operational details including freight costs, supplier relationships, 3PL arrangements, and system configurations
- Strategic information including growth plans, acquisition targets, product development, and market positioning
- The identity of other OpsX Mentor members (without their explicit consent to be identified)
- Session content, frameworks, and methodologies shared within OpsX Mentor group sessions
- Any information communicated in the context of a Fractional COO engagement
2. Obligations of All Members
All OpsX Mentor members agree to:
- Hold all Confidential Information in strict confidence
- Not disclose any Confidential Information to any third party without prior written consent from the disclosing party
- Use Confidential Information only for the purpose of participating in OpsX Mentor — not for any competitive, commercial, or personal advantage
- Not record, screenshot, or reproduce session content without explicit permission from OpsX and all participating members
- Notify OpsX promptly if they become aware of any actual or potential breach of confidentiality
3. OpsX Obligations
OpsX Pty Ltd commits to the same obligations. Specifically:
- We will not disclose any member's or client's Confidential Information to any other member, client, or third party without explicit consent
- P&L documents and operational data submitted as part of an application or engagement are accessible only to Patrick Callanan and are not shared internally or externally
- We will not use any member's or client's information for any purpose other than delivering the OpsX service
- Anonymised, aggregate insights may be referenced in the program context — never in a way that could identify a specific member
4. Formal NDA at Onboarding
This policy describes the framework. A formal mutual non-disclosure agreement is executed as part of the onboarding process for all accepted OpsX Mentor members and Fractional COO clients. The formal NDA governs in the event of any conflict with this policy.
The NDA is mutual — OpsX is bound by the same obligations as the member or client.
5. Duration
Confidentiality obligations survive the termination of OpsX Mentor membership or a Fractional COO engagement. Obligations continue for a period of three (3) years following the end of engagement, or indefinitely with respect to trade secrets or information that remains commercially sensitive.
6. Breach
A material breach of confidentiality obligations will result in immediate termination of OpsX Mentor membership without refund. OpsX reserves the right to pursue legal remedies for breaches that cause measurable harm to a member, client, or to OpsX itself.
