By accessing the OpsX website (theopsx.com) or engaging any OpsX service, you agree to be bound by these Terms of Service. These terms apply to all visitors, applicants, members, and clients. If you do not agree, please do not use our website or services.
Services are provided by OpsX, 50 Miller St, North Sydney NSW 2060.
OpsX offers three primary services:
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to affected clients or members.
Submission of an application does not constitute a right to membership or engagement. All applications are reviewed at our sole discretion. We may accept or decline any application without providing reasons.
OpsX Mentor membership is billed monthly in advance. Prices are as listed on the website at the time of application. We reserve the right to adjust pricing with 30 days written notice.
Fractional COO commercial terms, including fees and payment schedules, are documented in individual engagement agreements.
All prices are in Australian dollars (AUD) and exclusive of GST unless otherwise stated. GST will be applied where applicable.
OpsX Mentor memberships may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
We reserve the right to terminate a membership immediately and without refund if a member breaches these terms, the NDA policy, or acts in a manner that is harmful to other members or the program's integrity.
All OpsX Mentor members operate under a mutual NDA. The details are set out in our NDA Policy, which forms part of these terms by reference. Members agree not to disclose the identity, commercial information, or business details of other members.
Fractional COO confidentiality obligations are documented in individual engagement agreements.
All content on the OpsX website, including frameworks, methodologies, session materials, and written content, is the intellectual property of OpsX Pty Ltd. You may not reproduce, distribute, or create derivative works without prior written consent.
Session recordings, diagnostic outputs, and materials provided within the OpsX Mentor program are for the personal use of the member only and may not be shared or reproduced.
To the maximum extent permitted by Australian law, OpsX and OpsX Pty Ltd are not liable for any indirect, incidental, or consequential loss arising from your use of our services or reliance on any information provided.
Our total liability to you in connection with any service shall not exceed the total fees paid by you in the three months preceding the claim.
Nothing in these terms limits any right you may have under the Australian Consumer Law.
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of NSW.
